ChessVS is operated by ChessVS, Inc., a Delaware C-Corporation. The ChessVS Protocol is a separate, decentralised smart contract system deployed on Base L2 that ChessVS, Inc. helps build but does not control once deployed.

This section applies to on-chain features of the ChessVS Protocol — specifically the CVS governance token, FOCUS in-game reward, and any cards or packs implemented as on-chain assets. By interacting with any ChessVS Protocol smart contract, you agree to the terms in this section in addition to the general Terms of Service.

CVS Governance Token

CVS is a governance and utility token. It provides voting rights in protocol governance and access to in-game features including Season Pack purchases. CVS is not a security, investment contract, or financial instrument. Holding CVS does not entitle users to dividends, profits, or any share of company revenue.

FOCUS Reward Token

FOCUS is a closed-loop in-game reward earned exclusively through gameplay. It cannot be purchased with real money. FOCUS has no supported fiat off-ramp, no CVS bridge, and burns on use. Neither CVS nor FOCUS constitutes an investment in ChessVS, Inc. or any affiliate.

Packs & Cards

All card packs involve random card assignment. Published odds are available at chessvs.club/odds and encoded on-chain in BattleCard.sol. By purchasing a pack you acknowledge that: (a) odds are disclosed and independently verifiable, (b) purchasing packs does not guarantee specific cards, (c) the pity counter system guarantees Epic at pack 8 and Omega at pack 50 within a wallet's cumulative count for Grand and Season Packs, (d) pack purchase is entertainment, not gambling or investment.

FOCUS-denominated packs do not involve real money. CVS-denominated packs involve tokens with market value — users in jurisdictions where this may constitute regulated activity should not participate.

Fair Play & Anti-Cheat

Use of chess engines, manipulation of ELO rating, collusion, bot usage, and account smurfing are expressly prohibited. The protocol reserves the right to: (a) retroactively recalculate ratings and FOCUS balances for confirmed violations, (b) suspend or permanently ban wallets from economic features, (c) void tournament results where manipulation is confirmed, (d) burn FOCUS tokens minted during confirmed manipulation periods.

Users agree that the protocol's decisions on anti-cheat enforcement are final, subject only to the formal dispute resolution process outlined in the governance framework. General acceptable-use rules — including engine assistance during competitive matches, multi-accounting, account transfers, and harassment — are detailed in the Terms of Service §07.

Limitation of Liability — Token Activities

To the maximum extent permitted by law: (a) ChessVS, Inc. and the protocol Foundation are not liable for loss of token value, smart contract bugs, or blockchain network failures, (b) the protocol is provided "as is" with no warranty of uptime, performance, or token value, (c) liability is capped at the greater of $100 USD or fees paid to the protocol in the 30 days prior to the claim.

Smart contract risk: Users acknowledge that smart contracts may contain bugs or vulnerabilities. Despite audits, no contract is guaranteed bug-free. The protocol maintains a bug bounty programme — responsible disclosure is rewarded. Exploits are not. General service-level disclaimers and limitations of liability for the off-chain ChessVS service are detailed in the Terms of Service §10.

ChessVS gameplay is available globally. However, certain economic features — specifically CVS token purchases, Season Packs, presale participation, and TGE activities — are restricted or require additional compliance steps in certain jurisdictions. This list is maintained and updated regularly.
